1. About these terms
These Terms of Use (“Terms”) govern your access to and use of the automated chat assistant (the “Chat”) made available by Aligner Global Ltd (company number 13383343), 2 Moxon Place, Uxbridge, Middlesex, England, UB10 0TR, trading as Aligner Dental Academy (“we”, “us”, “our”).
The Chat is an artificial intelligence tool that responds to queries by drawing on a frequently asked questions knowledgebase and training course schedule information. By accessing or continuing to use the Chat, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the Chat.
We may update these Terms from time to time. The version in force is the one published on this page at the time you use the Chat. Your continued use after any change constitutes acceptance of the updated Terms.
2. Who may use the Chat
The Chat is intended for use by registered dental and healthcare professionals and by individuals making general enquiries about our training courses and services. It is not intended for use by patients or members of the public for the purpose of obtaining clinical or healthcare advice.
You confirm that any professional information you provide about yourself is accurate, and that you will use the Chat in accordance with the professional standards, codes of conduct and legal obligations applicable to you in your jurisdiction.
3. Nature and purpose of the Chat
The Chat is provided to assist with general, administrative and informational queries only. This includes matters such as course content, schedules, enrolment, events and similar administrative topics.
The Chat is an automated system. Its responses are generated by software and are not reviewed by a human before they are delivered to you, unless we expressly tell you otherwise. The Chat does not establish any professional, advisory, clinical or fiduciary relationship between you and us.
4. No clinical, medical or professional advice
The Chat does not provide, and must not be used to obtain, clinical, medical, dental, diagnostic, treatment or other professional advice.
Without limitation, the Chat is not intended to and must not be relied upon to:
• diagnose, assess or comment on any condition affecting any patient;
• recommend, plan, sequence or evaluate any treatment, procedure, product or appliance;
• interpret clinical records, images, scans or test results; or
• inform, support or replace any clinical decision relating to the care of any individual.
We design the Chat with safeguards intended to prevent it from responding to clinical questions and to direct such questions to a human. However, no automated safeguard is infallible. It remains possible that the Chat may generate a response that appears to address a clinical matter. Any such response is generated automatically, may be inaccurate, incomplete or unsuitable, and must not be relied upon under any circumstances.
If you have a clinical question, you must not rely on the Chat. You should consult appropriate qualified clinical sources, exercise your own independent professional judgement, and where appropriate contact our team for a human response.
5. Your professional responsibility
You are, and at all times remain, solely responsible for all clinical and professional decisions you make and for the care of your patients.
Nothing generated by the Chat reduces, transfers or qualifies that responsibility. You must apply your own professional judgement, knowledge, skill and the standards set by your regulator, and must independently verify any information before acting on it. You must not act, or refrain from acting, on the basis of anything the Chat communicates.
6. Accuracy of information
We take reasonable care to keep the underlying knowledgebase and schedule information accurate, but we do not warrant that the information provided by the Chat is accurate, current, complete or fit for any particular purpose. Course details, dates, availability and other information may change without notice.
The Chat may also produce responses that are incorrect, out of date or not relevant to your query, including content that appears plausible but is mistaken. You should verify any important information directly with us before relying on it.
7. Data, privacy and confidentiality
Your use of the Chat is also governed by our Privacy Policy [insert link], which explains how we collect and process personal data. Use of the Chat may be monitored, recorded and logged for quality, training, security and record-keeping purposes.
You must not enter into the Chat any patient-identifiable information, special category or sensitive personal data, confidential information, or any information you are not entitled to disclose. The Chat is not a secure channel for such information, and you are responsible for complying with your own data protection and confidentiality obligations.
8. Acceptable use
You agree not to:
• use the Chat for any unlawful, harmful or fraudulent purpose;
• attempt to manipulate, coerce or “jailbreak” the Chat into producing clinical advice or other restricted output, or to circumvent its safeguards;
• rely on the Chat as a substitute for professional advice or independent verification;
• input unlawful, infringing, confidential or sensitive personal data; or
• interfere with, disrupt, reverse engineer or attempt to gain unauthorised access to the Chat or its underlying systems.
We may suspend or withdraw access to the Chat at any time without notice.
9. Intellectual property
All content, software and materials made available through the Chat, other than your own inputs, are owned by or licensed to us and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable right to use the Chat for its intended purpose. No other rights are granted.
10. Disclaimer of warranties
To the fullest extent permitted by law, the Chat is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties or terms as to satisfactory quality, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Chat will be uninterrupted, secure or error-free.
11. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under applicable law.
Subject to the paragraph above, and to the fullest extent permitted by law:
• we exclude all liability for any loss or damage arising from your use of, or reliance on, the Chat or any response it generates, including any clinical or professional decision taken or not taken on the basis of such use or reliance;
• we are not liable for any indirect, consequential, special or incidental loss, or for any loss of profit, revenue, goodwill, data, anticipated savings or business opportunity, however arising; and
• our total aggregate liability arising out of or in connection with the Chat and these Terms shall not exceed [insert capped amount, e.g. the amount you have paid us for the relevant service, or a fixed monetary cap].
12. Indemnity
To the fullest extent permitted by law, you agree to indemnify us against any claims, losses, liabilities, costs and expenses arising from your misuse of the Chat, your breach of these Terms, or your reliance on the Chat in breach of these Terms.
13. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save where mandatory local law in your jurisdiction provides otherwise.
